1. Acceptance of Terms

By accessing or using services provided by Hypereach, LLC ("Company", "we", "our", or "us"), including our website, digital campaigns, CRM integrations, or other marketing solutions, you ("Client", "you", "your") agree to be bound by these Terms of Service. If you do not agree, do not access or use our services.

2. Services Provided

Hypereach offers digital marketing, advertising campaign management, appointment setting, automation, SEO, and consulting services primarily for HVAC, roofing, and restoration industries.

3. Client Responsibilities

Clients agree to:

• Provide accurate business and contact information.
• Respond promptly to communication requests.
• Cooperate in content approvals, ad campaign adjustments, and CRM onboarding.
• Ensure compliance with industry-specific regulations (including A2P 10DLC, TCPA, etc.).

4. Payment Terms

• Services are billed as agreed in your contract or onboarding form (e.g., pay-per-appointment, retainer, or flat rate).
• All payments are due on the invoice date unless otherwise stated.
• Late payments may result in paused campaigns or suspended access to platforms.

5. Refund Policy

Due to the nature of digital services and lead generation, all payments are non-refundable once a campaign or service has commenced. Custom exceptions may be made at our discretion.

6. Intellectual Property

All creative assets, campaigns, scripts, and automation flows developed by Hypereach remain our intellectual property unless otherwise agreed in writing. Clients receive a license to use deliverables for business purposes only.

7. Third-Party Platforms

We may use third-party tools such as GoHighLevel, Facebook Ads, Google Ads, or Make.com. Hypereach is not liable for downtime, errors, or policy changes from these platforms.

8. Privacy

Please refer to our Privacy Policy for details on how we collect, store, and use your data.

9. Limitation of Liability

To the maximum extent permitted by law, Hypereach is not liable for indirect, incidental, or consequential damages, including loss of business, data, or revenue.

10. Termination

Either party may terminate services with written notice (14 days minimum). Hypereach reserves the right to terminate immediately in cases of non-payment, fraud, or abusive behavior.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.

12. Modifications

We may update these Terms of Service at any time. Continued use of our services after such changes implies acceptance of the updated terms.

13. SMS/Text Messages Terms

Program description: Hypereach LLC sends text messages to individuals who have submitted a form on our website or landing pages and provided express written consent. Messages include appointment scheduling, confirmations, reminders, follow-up regarding your inquiry, and occasional promotional offers.

Consent: You opt in by checking the consent box next to the phone number field on our forms. Consent is not a condition of purchase.

Message frequency: Message frequency varies based on your interaction with us.

Cost: Message and data rates may apply. Hypereach does not charge for text messages, but your mobile carrier's standard rates apply.

Opt out: Reply STOP to any message to unsubscribe. You will receive a confirmation and no further messages.
